Having no powers to veto the law for the third time the President of Ukraine applied to the Constitutional Court of Ukraine

The President of Ukraine Viktor Yuschenko has twice vetoed the Law of Ukraine № 922 «Оn amending of some laws of Ukraine with regard to prevention of negative consequences of impact of the global financial crisis on development of the agro-industrial complex». But on March 03, 2009 the Supreme Counsel of Ukraine overrode the President’s veto and the law was adopted.

As the result of such situation the President of Ukraine has used the other legal mechanism on the way towards achievement of his objective – applied to the Constitutional Court of Ukraine with the request to determine constitutionality of clause 11 of section III «Final Provisions» of the Law of Ukraine «On the high propriety measures of prevention of negative consequences of impact of the global financial crisis and on the amending of some legislative acts of Ukraine» dd. 31.10.2008.

It is interesting that the clause of the law constitutionality of which admitted of President’s doubt was included into the Law of Ukraine «On the high propriety measures of prevention of negative consequences of impact of the global financial crisis and on the amending of some legislative acts of Ukraine» by the very Law № 922 that had been twice unsuccessfully vetoed by the President.

On November 24, 2009 the Constitutional Court of Ukraine ruled the Law of Ukraine № 922 «Оn amending of some laws of Ukraine with regard to prevention of negative consequences of impact of the global financial crisis on development of the agro-industrial complex» unconstitutional for a formal reason – mentioning of the wrong date of the law’s adoption.
