Extension of jurisdiction of administrative courts of Ukraine over land disputes

On April 01, 2010 the Constitutional Court of Ukraine having considered constitutional application of the Supreme Administrative Court of Ukraine officially construed clause 1 of paragraph 1 of article 17 of the Ukrainian Code of Administrative Court Procedure.

In accordance with the clause 1 of paragraph 1 of article 17 of the Ukrainian Code of Administrative Court Procedure administrative courts have jurisdiction over disputes arising between physical persons or legal entities and power entities regarding appeal of their decisions (regulatory or individual legal acts), actions or inactivity.

The Constitutional Court of Ukraine construed the legal provision mentioned in the context of legal relations connected with land and resolved that clause 1 of paragraph 1 of article 17 of the Ukrainian Code of Administrative Court Procedure is to be understood so that land disputes arising between physical persons or legal entities and local authorities as power entities regarding appeal of decisions, actions or inactivity thereof are to be referred to the public disputes administrative courts have jurisdiction over.
