ALEXANDROV & PARTNERS Represented its Client to Seek the Enforcement of a Foreign Judgment in Ukraine

The lawyers of ALEXANDROV & PARTNERS successfully represented their Client and obtained a judgment from one of Kyiv local courts allowing them to enforce the award rendered by Vilnius Commercial Arbitration Court. It resulted in the collection of debt and penalties totaling UAH 2,000,000 from a Ukrainian resident in favor of the Client.

During the consideration of application on approval of enforcement in Ukraine of the foreign judgment by a local court of first instance, the Parties conducted lengthy debates regarding due notification of a debtor of the hearing of the case on merits by the foreign arbitration, because this very fact was of an utmost importance for the delivering of judgment in favor of the Client by the Ukrainian court.

However, based on the results of the hearing, the claimant was allowed to enforce a foreign award in Ukraine. The ruling of the first-instance court was also upheld by Kyiv City Appellate Court.
